Is there a right to seek asylum under international law?

Seeking asylum in Australia, or elsewhere, is not illegal. In fact, it is a basic human right. All people are entitled to protection of their human rights, including the right to seek asylum, regardless of how or where they arrive in Australia, or in any other country.

On what grounds can you seek asylum?

You must apply for asylum if you want to stay in the UK as a refugee. To be eligible you must have left your country and be unable to go back because you fear persecution. Apply for a visa if you want to come to the UK for another reason (for example to work, study or remain with family).

To establish past persecution, an applicant must show an incident, or incidents, that rise to the level of persecution; that is on account of a protected ground; and was committed by the government or forces the government was either unable or unwilling to control.
